This Vacation Rental Agreement (the “Agreement”) is made by and between BLUE HERON INN VACATION RENTAL (“Property Manager”) and ________________________________ (“Guest”) as of the date set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties agree:


The property, herein-after referred to as Blue Heron Vacation Rental, is located at: 10412 Main Street, Findley Lake, N.Y. 14736. Guest takes possession of a fully-furnished, 4 bed and 4-1/2 bath home that includes: 

  • Bedrooms:
    FOREST GROVE: 1 Full & 1 Twin - sleeps 3
    GARDEN ROOM: Queen bed - sleeps 2
    LAKE VIEW: Queen bed - sleeps 2
    ROD & CREEL: King bed - sleeps 2
    ADDITIONAL: 1 Roll-away bed - sleeps 1
  • Kitchen is equipped with stove, oven, refrigerator/freezer, dishwasher, microwave, toaster, coffee maker, dishes, glasses, silverware, pots, pans, etc.Living room, dining room, bar, sitting room, porches and deck are fully furnished.
  • Dining Room features a custom farm table with seating for 12.Full Bar is equipped with dry sink and small refrigerator.
  • Laundry Room features full-size Washer & Dryer, iron, first aid and sewing kits.
  • All paper products, as well as kitchen and laundry supplies, are provided.
  • Porches and deck are fully furnished; Lake view deck with awning (May – October) provides multiple seating arrangements plus dining for 12.
  • Wrap-around sun porch seating area and side porch breakfast/game room with lake view.
  • Gas barbecue grill is provided on the back patio.
  • Fire ring is in the back yard behind the red barn.
  • Handicap ramp to the first floor and handicap-accessible bathroom on 1st floor.
  • All bedrooms are equipped with bed linens, comforters, blankets, pillows, towels, bath mats, hair dryers, toilet paper and tissues.


    Guest acknowledges and agrees to the pay the applicable fees as appear in the Reservation Quote and as outlined below:

    A. SALES & OCCUPANCY TAXES – 5% Chautauqua County Occupancy Tax

    We are exempt from charging NYS Sales Tax, however, we are required to collect Chautauqua County’s 5% Occupancy Tax on all rental charges.

    B. CLEANING FEE - $150


    This non-refundable POM Travel Insurance fee is required in lieu of obtaining a security deposit prior to arrival. This Insurance protects you in the event there is unintentional theft/damage to the premises during your stay.


    A. Please refer to accompanying Reservation Quote.

    B. This property requires a 3-night minimum stay. Longer minimum stays may be required during holiday periods.


    A. DEPOSIT: 50% of total reservation charges is due at the time reservation is made (includes total nightly rents plus all applicable fees). Regardless of the origin of the reservation, (Blue Heron website or 3rd party lodging directory), Guest's credit card information must be provided in full to the Property Manager.

    B. BALANCE: Remaining balance due 90 days prior to arrival.


    1. 90% of paid prepayments are refundable when cancelled 90 days prior to the date of arrival.
    2. No payments will be refunded if cancelled less than 90 days prior to date of arrival.

    D. SAME-MONTH RESERVATIONS: Reservations made by phone and/or online within 30 days of arrival are payable in full at the time of reservation. No refunds will made for cancellation.

    E. EARLY CHECK OUT: No refunds will be made for early check-out for any reason.

    5. CHECK-IN / CHECK-OUT 3:00 PM

    A. Check-in: 3:00 PM
    Check-out: 10:00 AM

    B. The housekeys are stored in a “Lockbox” mounted to the side of the outside storm door. A code will be provided to open the box manually. Bluetooth access is also available via the Master Lock Vault eLocks app, available for both Android and IOS.

    C. There is a keyless touchscreen deadbolt with alarm on the inside front door. A code will be provided to open the lock manually.

    D. Guest agrees to leave the premises “broom clean”; it should be left in the same condition in which it was found at the time of check-in. A check-out list will be
    provide as a guide to help you gather your belongings.

    PLEASE NOTE: We have a very limited window of opportunity to clean and prepare the house for incoming guests; we must, therefore, enforce our 10:00am check-out time. $50 per hour will be charged if guests remain on premise and the cleaning crew is unable to start by 10:15am.


    The rental party shall consist of Guest (must be at least 30 years of age with a government issued picture ID), and the following persons (list names/ages):

    NOTE: Rental rates are based on a maximum occupancy of 10 guests. An additional charge of $50.00 per person per night will be assessed for more than 10 guests.


    Guest, members of the rental property and visitors agree to abide by the following Rental Rules while in residence:

    A. MINIMUM AGE & ID REQUIREMENTS: Guest of record must be at least 25 years of age. A valid Driver's License or other form of picture ID is required to be provided to Owner prior to renting.

    B. ADDITIONAL GUESTS: Visitors other than those in the Guest party set forth above may not stay overnight in the property. All other persons in or on the property are the sole responsibility of Guest. If this rule is violated, Guest will be assessed an additional fee of at least $500.00.

    C. LIABILITY: The Blue Heron Vacation Rental is privately owned; the owner is not responsible for any accidents, injuries or illness that occur while on the premises or its facilities. The Owner is not responsible for the Guest’s loss of personal belongings or valuables. By accepting this reservation, it is agreed that Guest (and others who are invited to use the premise) expressly assume the risk of any harm while in possession of premise.

    D. FURNISHINGS/APPLIANCES: Keep the property and all furnishings clean and in good order. Do not move the furniture. Appliances are to be used for their intended purpose only.

    E. BIKES/BOATS: There are 4 adult bikes, 2 kayaks and a paddle boat for Guest use. Use of these items require a signed copy of our Recreational Vehicle Liability Waiver and Release Form. Guest understands and assumes any/all risks involved in using the recreational vehicles and also relieves the Property Manager of liability for any/all damage or injury which may result from reckless or improper use of the recreational vehicles. Parental supervision and use of accompanying safety items are required at all times.

    F. PETS: Pets are NOT allowed in or on the property at any time. If pets are found to be in or on the property, Guest will be assessed an additional fee.

    G. LINENS/TOWELS: While linens and bath towels are provided in the daily rental fee, there is no daily housekeeping service. Guests are not permitted to remove towels or linens from the house. Please bring your own beach towels.

    H. KITCHEN: The kitchen is fully stocked with dishes, glassware, flatware, pots and pans, dish towels, storage containers and paper products. There is a commercial exhaust fan for use as needed.

    I. GARBAGE: A commercial dumpster is provided and emptied bi-weekly.

    J. GAS FIREPLACE: A fireplace operation manual is provided for Guest’s use. Please do not throw any paper or other combustible materials in the fireplace.

    K. GAS BBQ GRILL: A propane barbecue grill is provided for year-round Guests use. Please be sure it remains on the brick patio where it belongs and that it is completely turned off and properly cleaned and covered after each use. If you need to change the propane tank, please leave the empty tank on the patio & a note on the check-out sheet.

    L. WELL & SEPTIC SYSTEM: The Property operates on well and septic systems. The septic system is very effective; however, it will not run efficiently if improper material is disposed within.

    SINKS: Do not put food, grease or other sold items down the drains.
    TOILETS: Do not flush anything other than toilet paper. No feminine products, paper towels, etc. should be flushed at any time. If food or products other than toilet paper have been flushed and cause damage to the septic system, the Guest will be charged the cost of repairs.

    M. SMOKING: Smoking is NOT allowed anywhere in or on Cottage property. This includes covered deck, porches and patios. A $250 cleaning fee will be charged if guests smoke on the premises.

    P. OWNER/SUB-CONTRACTOR ACCESS: Guest shall allow Owner and/or their sub-contractors to access the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.

    Q. LONG-TERM HOUSEKEEPING: Reservations for more than 7 days will require a "stayover" cleaning at the additional cost of $50 per week. The Property Manager will schedule the weekly cleaning at the Guest's convenience.

    NOTE: We do not live in Findley Lake, however, we live close by and are readily accessible by phone; we have a Plumber and an Electrician on call at all times. In the case of a life-threatening emergency, please call 911. The Blue Heron street address is 10412 Main Street, Findley Lake, NY 14736.     The parties agree to the terms of this Vacation Rental Rules and Terms of Agreement, as is evidenced by the signatures set forth:
